Brown Mogotsi’s fourth bail application at the Johannesburg Magistrates’ Court was postponed to 1 September 2026 after the State said it still needed a Correctional Services report on an alleged escape plot. Magotsi has been in custody since his arrest in May 2026 and faces charges including perjury, defeating the ends of justice, unlawful possession of a firearm and ammunition, and discharging a firearm in a public place.
The investigating officer told the court he received information about the alleged escape plan on 20 August 2026 at 07:29. According to the officer’s statement, read into the court record, the plan was that Mogotsi would disguise himself in a correctional services uniform and walk out of the Johannesburg Magistrates’ Court cells.
NPA Gauteng spokesperson Magaboke Mohlatlole said a Correctional Services official alerted the investigating officer to the alleged plan. “Arrangements were subsequently made to prevent the accused from escaping,” Mohlatlole said, confirming that security measures were tightened at the court.
The State also alleges that Mogotsi staged an attempt on his own life in Vosloorus in November 2025 and that forensic evidence and CCTV footage contradicted his account of that incident. Those allegations form part of the broader charge sheet but remain disputed in court proceedings.
Defence advocate Nthabiseng Mohomane did not oppose the postponement but asked the court to set a final date for the report’s submission. “At this juncture we do not have an objection to the matter being remanded, but can the court make the date that follows final for purposes of that report,” she said during proceedings on 25 August 2026.
The escape allegation itself remains unverified and has not been tested in court. All available reporting from EWN, The Citizen, and IOL frames it strictly as a State allegation, and no source confirms Mogotsi actually attempted to escape. The outstanding Correctional Services report is expected to shed further light on the claim when proceedings resume.
The Cape Flats will check in on 1 September 2026 when the matter returns to court and the State is due to produce the report. What remains unknown is whether the report will substantiate the escape allegation or whether the defence will challenge its contents.
